1. Introduction

Welcome to YardSmart, a platform that allows users to rent tools and equipment to one another. By accessing or using the YardSmart app or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, and others who wish to access or use the YardSmart services, including both renters and equipment owners.

2. Services Provided

YardSmart provides a platform that connects people who wish to rent tools and equipment ("Renters") with people who wish to lend their equipment ("Owners"). YardSmart allows users to list equipment, book rentals, and facilitate payment transactions for the rental of tools and equipment.

3. Account Creation and Use

To access and use YardSmart, you must create an account. By creating an account, you agree to:

• Provide accurate and up-to-date information about yourself.

• Maintain the confidentiality of your account credentials.

• Be responsible for all activities that occur under your account, whether authorized or not.

• Inform YardSmart immediately of any unauthorized use of your account.

4. Renting and Listing Equipment

• Equipment Listings: Owners may list their equipment for rent on YardSmart. Equipment listings must include accurate descriptions, images, and rental terms. Owners are responsible for ensuring the equipment is safe, functional, and legally compliant with local regulations.

• Renting Equipment: Renters can browse listings and request to rent equipment through the app. Renters agree to follow the agreed-upon rental terms, including payment, return, and any other specific conditions outlined in the rental agreement.

• Rental Period: Each rental agreement will specify the start and end dates for the rental period. Renters must return the equipment in the condition agreed upon at the time of rental.

5. Payments and Fees

• Rental Payments: Renters agree to pay the listed rental price for the equipment. Payments will be processed through the YardSmart app, and YardSmart may charge a service fee for facilitating the transaction.

• Payment Methods: Payments must be made using a valid payment method registered in the YardSmart app. You agree to pay all applicable fees and taxes associated with the rental.

• Cancellation and Refunds: Renters or Owners may cancel a rental under certain circumstances. Refunds or adjustments will be determined according to our cancellation policy, which is available within the app.

6. Responsibilities of Renters

• Inspection: Renters agree to inspect the equipment before use. If there are any issues with the equipment, Renters should notify the Owner immediately.

• Return of Equipment: Renters are responsible for returning the equipment on time and in the condition it was rented. Failure to do so may result in penalties, additional fees, or the suspension of the account.

• Damage or Loss: Renters are liable for any damage to or loss of the equipment during the rental period. Renters agree to compensate Owners for repair or replacement costs as necessary.

7. Responsibilities of Owners

• Equipment Condition: Owners must ensure that the equipment is safe, clean, and in good working order before listing it on YardSmart. Owners are responsible for maintaining and inspecting their equipment.

• Rental Terms: Owners must provide clear rental terms, including rental duration, fees, and any specific instructions for the use of the equipment.

• Insurance: Owners are encouraged to verify whether their equipment is covered by personal or rental insurance. YardSmart is not responsible for any accidents or injuries that occur while using rented equipment.

8. Prohibited Activities

You agree not to:

• Use the YardSmart platform for any unlawful or fraudulent activities.

• Engage in any activity that would harm the platform, its users, or its services, including hacking, data scraping, or unauthorized access.

• Violate any local, state, or national laws in connection with the rental or use of equipment.

9. Termination and Suspension

YardSmart reserves the right to suspend or terminate your account if:

• You violate these Terms of Service.

• Your account is used for fraudulent or unlawful activities.

• You fail to comply with any other rules or regulations specified by YardSmart.

If your account is terminated, you may lose access to your rental history, payment information, and any other account data.

10. Liability and Disclaimers

• Limitation of Liability: YardSmart is not responsible for any injury, loss, damage, or financial loss that occurs during the rental of equipment. Renters and Owners use the platform at their own risk.

• No Warranty: YardSmart provides the platform "as is" and makes no warranties regarding the availability, functionality, or security of the app or its services.

11. Indemnification

You agree to indemnify and hold YardSmart harmless from any claims, damages, or expenses arising from your use of the platform, including but not limited to:

• Breach of these Terms.

• Any disputes between Renters and Owners.

• Damage to or loss of rented equipment

12. Privacy and Data Collection

YardSmart collects personal data to provide the services. For more information on how we handle your data, please refer to our Privacy Policy.

13. Modifications

YardSmart reserves the right to modify these Terms of Service at any time. When we update these Terms, we will notify you via the app or email. Continued use of the service after modifications constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which YardSmart operates. Any disputes arising from the use of the service will be resolved through binding arbitration, in accordance with applicable laws.
